SIMPLE CARE HEALTH PLAN CONTRACTING CONDITIONS

Simple Care Health Plan Membership Agreement

A) PARTIES IDENTIFICATION

The first party, D. Juan José Bazán Ortega, administrator of Simple Health Care, S.L., (CIF. B92961713), with the society address at avenida de Andalucia,  138 bajo, 29793 Torrox Costa, (Málaga). Hereafter known as Simple Care.

The second party (principle person applying for membership plus any additional Family members)

B) SIMPLE CARE:

Simple Care have a register of carefully selected, quality healthcare providers, wellness clinics, spas and associated services. Each of the providers listed by Simple Care, have agreed to avail their services to the members of Simple Care, at privileged rates. The rates have been pre-negotiated by Simple Care, and are offered and charged directly to the member by / from the healthcare provider, clinic, spa, wellness clinic or associated services at the time of treatment and or services being rendered or received. No payments are made to / or are on behalf of Simple Care, for any healthcare or associated services. All transactions are strictly between the member and the healthcare provider of their choice.

Members pay an annual fee, to maintain membership. The Simple Care membership, allows members access to selected healthcare providers, at pre-negotiated & privileged rates.

C) SIMPLE CARE ANNUAL MEMBERSHIP FEE:

  • Individual: 59 €
  • Couple: 99 €
  • Each additional family member (under the age of 16): 19 €
  • Each additional family member older than 16: 49 €

Signing this document; forms an agreement and your acceptance, of the following terms and conditions:

D) CLÁUSES

1º THE TERM OF THIS CONTRACT

The term of this contract is one year. The expiry date of this contract coincides with the membership card expiry date of the membership.

This contract will be automatically renewed, for subsequent annual membership unless Simple Care are notified (in writing) by the member within 30 days (11th month) of the current membership.

2º PRICE AND WAY OF PAYMENT

Simple Care reserves the right, to amend each year the cost of the Simple Care membership card, appropriate to the consumer price index (CPI) and market conditions.

3º USING THE SIMPLE CARE CARD

The membership card, allows members of Simple Care, access to discounted treatment rates from selected healthcare providers, spas, and associated services. The selected healthcare providers and services are listed by Simple Care.

The term of membership is for one year.

The Simple Care membership card belongs to, and is the sole property of the person who is named, and has signed the card. Each member has their own membership card. Membership cards are not transferable. All members of Simple Care must show evidence of identification, at each appointment/visit, to any of the selected  health care provider, clinic, spa etc.

The simple Care membership card, is not a credit/debit card, or means of payment in any way. The payment for healthcare and wellness services must be made directly to the provider of the treatment, or those who have provided the service.

It is the members responsibility; to immediately report, cases of loss, damage or theft of a card.

Simple Care is not responsible, for non compliance.

Simple Care reserves the right, to withdraw/retrieve any membership card which is believed to be used, in a fraudulent or improper way, or seen to be violating the Simple Care terms and conditions.

4º LIMITATION OF LIABILITY.

Simple Care shall not be responsible, for any incident or accident, personal or otherwise. Caused by, whilst in the care of, or whilst on the premises of, any providers listed by Simple Care.

5º PRIVACY POLICY

In accordance with, the provisions of law, 15/1999 dated December 13th, protection of personal data.
Any personal data, given/provided to Simple health Care SL (customers, members, providers) duly declared in the Spanish data protection laws, will be used for the handling of the contracted services.
It’s use, where appropriate, relevant and non excessive in relation to the purpose, for which they were given and obtained. Please note: Your information may be communicated to financial institutions and other measures, for handling or contractual services.

Simple health Care SL agrees to make personal data available to the individual/owner of said data. Simple health Care SL recognises the right, of any individuals choice, to withdraw, cancel or rectify personal data. 6º IN THE CASE OF DISPUTES

All parties agree, in the event of a dispute or disagreement relating to this contract, the case will be judged and resolved in the courts at Torrox, Malaga.

7º REVIEW OF PROVIDERS/SERVICES LISTED

In the interests of maintaining and expanding the list and the availability of selected quality healthcare providers, for Simple Care members, Simple Care reserves the right to introduce or remove providers and services listed without prior notice. Any additions, or exclusions to the list of providers, will be communicated via the website. www.getsimplecare.es.
